World Vision loses case against employee

A FORMER development facilitator employed by World Vision in Chipinge will get his salary backdated to 2011 after an arbitrator ruled that his dismissal was unfair.
Steven Sithole who was a World Vision employee since 2000 registered the matter with the Chipinge Magistrates’ Court where a warrant of execution was granted which led to the attachment of a Land-Cruiser Registration Number ABK3045 on June 2.

Sithole who was employed as development facilitator in Ward 20, Chipinge, was entitled to a salary of $477 a month which the company was ordered to pay.

According to the judgement from the arbitrator shown to The Manica Post, World Vision is expected to pay Sithole $6 000 for unfairly dismissing him from his duties and replacing him with another employee.

A dismissal letter written by World Vision programme manager, a Mr A. Ndanga dated September 2011, reads: “This letter serves to remind you that your current contract of employment is due to expire on September 30, 2011 due to financial challenges the organisation is facing.

Your contract will not be renewed after September 30, 2011.” But on September 25, of the same year, World Vision went on to employ another development facilitator to replace the complainant.

Sithole appealed against his dismissal at the National Education Welfare where the two parties failed to reach a settlement.
The matter was referred to an arbitrator.

The arbitrator, Ms Yilmaslu Malama, ruled in favour of Sithole.
The company has since filed an urgent chamber application for a stay of execution with the Labour Court and the matter is still to be heard.
