A MUTARE woman last week stunned the Mutare Civil Court when she dragged her ex-husband believed to be in his late 70s to court demanding $300 spousal maintenance.

Agnes Musoso dragged Simon Makaya who is now a pensioner to court, with the former citing unfulfilled promises from the days when they were still staying together.

Makaya was already paying $80 spousal maintenance to Musoso per month. Ms Anniah Ndiraya presided over the matter.

Musoso told the courts that the $80 that her ex-husband had been paying was included in the $300 that she was claiming.

“He promised to build a house for me when we were together and now I want it because I do not have anywhere to stay. I want to use the $300 to mould bricks, buy window frames and iron sheets to roof the house that I intend to build,” said Musoso.

“Moreso, he not been paying the $80 since April.”

Musoso was advised by Ms Ndiraya that the issue of building a house should not be part of her maintenance claim. In response, Makaya told the court that he was a pensioner.

“I am getting less than $200 as pension and how does she wants me to build the house or raise the money that she is claiming. Moreover, we are no longer staying together and I have other responsibilities to meet as a man. My children are my witnesses because they are the ones whom she has been sending to get money and groceries for me,” said Makaya.

He added that he was giving Musoso $60 cash and groceries worth $20 ever since the court ordered him to take care of her.

Ms Ndiraya ordered Makaya to deposit the $80 straight into Musoso’s bank account to avoid misunderstandings.
