MUTARE businessman Isau Mupfumi has refuted ever buying timber from Allied Timbers as alleged by the company.
Speaking through his lawyer, Victor Chinzamba, Mupfumi said an independent contractor instead bought the timber from Allied Timbers that was used at Mupfumi’s residence on a fix and supply basis.
He denied that his Fairbidge Park house (Stand No 2321) was ever attached.
The matter will be heard in court on September 10.
“The matter is pending at court. Nothing is being attached. It was not him who purchased the timber.
The contractor purchased the timber and used it at Isau’s house but the company is now suing my client.
“This person was engaged on a fix and supply basis. That person actually accepted in court that he is the one who bought timber and used it at Mupfumi’s residence,” said Mr Chinzamba.
Allegations are that the businessman-cum-politician bought trusses from Allied Timbers for $9 292, 82 in 2013 and reportedly failed to pay for the material upon delivery in August 2013
Allied Timbers then took the matter to court demanding that he settles the debt. It was heard that Allied Timbers managed to obtain a writ of execution against the property last week at Mutare Magistrates’ Court. The matter was under case No.1446/15.
The writ of execution was granted after Mutare Civil Court magistrate Mr Lazarus Murendo made a default judgment after Mupfumi failed to appear in court for the hearing. Mupfumi said he failed to attend a court hearing on July 7, 2018 as he was busy preparing for the elections.
In his ruling magistrate Murendo said: “Court business takes precedence over any other business despite the fact that the defendant was an aspiring candidate in the elections. The court also noted that the respondent never set his foot in the court since the matter started.”
