Neighbours in cattle grazing land dispute

TWO neighbouring families have gone to the courts to find a lasting solution to unending disputes that arise from stray cattle that graze in each other’s yards.

Benjamin Zaranyika took Stanley Chokoto and his wife, Spiwe Mwaitawepi to court seeking a protection order against the couple.

He said he was being insulted and threatened whenever his cattle pass or graze in their yard. Mrs Annia Ndiraya heard the matter.

Zaranyika told the court that he wanted protection against his neighbours because he now fears for his life.

“Each time my cattle cross into their land I receive incessant threats and insults from these two and their children. Their children even go to the extent of promising to bewitch me and my family. I’m now afraid and I now need the court’s intervention,” said Zaranyika and added:

“We already had an altercation over the land in which they are staying because it belonged to my late grandfather. Even the headman is convincing me to make an offer so that I leave them there but I want my land”.

In response, Mwaitawepi told the court that they bought the land from Zaranyika’s grandfather in 1988 before he died.

“We bought that land from his grandfather in 1988 and started staying there in 1995. He is the one disturbing our peace and why would he want to take that land now? Where has he been all this while?

“This matter is even before Headman Four Corner,” said Mwaitawepi. In her ruling, Mrs Ndiraya ordered the two families to observe peace against each other and make sure that their animals don’t trespass into each other’s premises to avoid misunderstandings.

“Observe peace against each other until the headman settles your land dispute,” she said.
