A 62-YEAR-OLD Mutasa man who failed to control his sexual appetite and raped a mental patient thereby infecting her with the HIV virus as well as impregnating her has been hauled before the courts.
Noah Katsidzira appeared before Mutare magistrate, Miss Perseverance Makala last Friday.
He denied the two charges of deliberately transmitting HIV as defined in Section 79 of the Criminal law (Codification and Reform) Act, Chapter 9:23 and rape as defined in Section 65 as read with Section 64 (3) of the Criminal law (Codification and Reform) Act, Chapter 9: 23.
Mr Fletcher Karombe prosecuted. The court heard that on an unknown date but in 2017, Katsidzira raped the complainant who is mentally challenged. She did not tell anyone but fell pregnant.
In September the complainant gave birth and she then disclosed to the midwives that Katsidzira had raped and impregnated her. It was also discovered that the complainant who was not HIV positive before, had contracted the virus.
“Katsidzira was approached and he promised to take care of the child after apologising to the complainant’s father. He however, failed to own up to his word resulting in the complainant’s father reporting the matter to the police,” said Mr Karombe.
Katsidzira was denied bail and advised to apply for bail at the High Court in Harare.
