A 31-YEAR-OLD Buhera man who infected his eight-year-old niece with a sexually transmitted disease was last Friday jailed 20 years.
Right Hamutyi of Parozvi Village under chief Chamutsa appeared before regional magistrate, Mr Richard Chineka facing rape charges.
He pleaded not guilty to the charges but was jailed after overwhelming evidence nailed him.
Representing the state, Mr Witness Nyamundaya said sometime in October last month on a date unknown to the prosecutor but during the night, the complainant who is a niece to the accused was lying on a mat on a floor.
Mr Nyamundaya said the accused was seated on a bed in the same room while the complainant’s grandmother was outside preparing supper.
“Hamutyi then stood up from the bed and went to where the complainant was lying. He lifted the complainant and put her on the bed,” he said.
Mr Nyamundaya said the accused told his niece that he wanted to have sexual intercourse with her and he also threatened to stab her with a knife if he cried for help.
“The complainant tried to scream but the accused put his hand on muffle her screams. The accused person then lifted up the complainant’s skirt and removed her pants. He got on top of the complainant and forcibly had sexual intercourse with the juvenile.
“After the attack, the complainant went to lie down on her mat. Her grandmother finished cooking supper and went inside but the complainant failed to report the matter since she was afraid of being stabbed by the accused,” he added.
Mr Nyamundaya said on October 12 around 3pm, the complainant went to her mother Sarudzai Mabika‘s place of residence in Tama Village under chief Chamutsa.
“Upon arrival her mother noticed that her daughter had difficulties walking. She then asked the complainant why she was limping and the complainant just said that her leg was painful.
“The matter came to light on October 15 when the mother discovered that the complainant was emitting a bad odour from her privates.
“She then took her into the house where she discovered that her daughter was discharging a white fluid from her private parts that were also bruised. Upon interrogation the girl revealed everything that had transpired. The matter was reported to police leading to the arrest of the accused.
“The complainant was also tested for STIs and she was found to be syphilis positive,” he said.
The accused, Hamutyi was jailed 20 years, six of which were suspended on condition of good behaviour.
