Chief Makoni’s property finally attached

The Messenger of Court last Friday finally managed to attach controversial Chief Makoni Mr Simbayi Colgen Gwasira’s property without any hassles more than a year after failing to do so.

Employees from the Messenger Court attached Gwasira’s Hino truck, registration number ACI 9191 which was parked at his court situated in the Central Business District. Gwasira had not yet arrived at the traditional court and only his aides were present and claimed that they do not have the lorry keys. The lorry which is used by his aides when attaching villagers’ belongings was towed by a Nissan Wolf double cab.

Last year Gwasira threatened to assault two Messenger of Court officers, who were in the company of three Zimbabwe Republic Police officers with knobkerries when they wanted to attach his property in fulfilment of a court order granted by a Mutare magistrate court.

Gwasira was dragged to the Mutare civil court by a villager who was appealing against the hefty fine of four beasts worth $1 600 imposed on him by the chief. The villager, just like many others who are appealing against Gwasira’s rulings, won his appeal and the chief was ordered to return all the four beasts.

Gwasira refused to return the cattle or $1 600 as per court order prompting the villager to register his award with the Messenger of Court who also failed to attach his property leading to them lodging a police report.

Chief Makoni was arrested and convicted of obstructing the Messenger of Court from executing his duties with the Nyanga magistrate describing him an embarrassment.

A source at the Messenger of Court told The Manica Post that if Gwasira does not comply with the order and execution costs within 14 working days, his lorry will be put on auction.
