Braai misunderstanding turns nasty

SIX Dangamvura men who assaulted a pair over a braai misunderstanding at a local bar were convicted of the offence by a Mutare court. Byron Musakaruka (26), Trynos Mumera (19), Nolan Rashayi (42), Kudakwashe Maruta (25), Tapiwa Rashayi (25) and a minor denied the two counts of assault when they appeared before Mutare magistrate, Mr Poterai Gwezhira.

They were being charged with two counts of assault as defined in Section 89(a)(i) of the Criminal Law (Codification and Reform) Act, Chapter 9:23. Prosecuting was Mr Matthew Chimutunga.

It was alleged that on August 9, 2016 and at Hanzu Business Centre in Hobhouse, all six unlawfully and with intend to cause bodily harm on Alois Kwaramba and Phillip Chatora assaulted them using broken beer bottles.

“They used the empty bottles to assault the two several times all over their bodies. Kwaramba sustained a deep cut just above his right eye, while Chatora sustained cuts all over his body,” said Mr Chimutunga.

In their defence, Rashayi and his accomplices said it was Kwaramba who was drunk who provoked them.They claimed they only retaliated in self defence as they were under attack from both Kwaramba and Chatora.

They also insisted that they had never assaulted Kwaramba with broken bottles and that he never sustained any deep cut above his right eye as had been alleged by the State. Mr Gwezhira ordered the five to fork out $150 each in fines. However, the minor’s sentence was suspended on condition of good behaviour.
