$980 maintenance arrears land man in court

A MUTARE man (38) appeared before Mutare Magistrates’ Court on Wednesday for failing to pay maintenance fees for his four children.Never Musekiwa who resides at House Number 180, New Chisamba, Sakubva pleaded guilty to contravening Section 23 of the Maintenance Act.

The father of six appeared before senior magistrate, Mrs Sekai Chiundura, while Mr Fletcher Karombe prosecuted.

He has $980 maintenance arrears. He told the court that on October 13, 2014, Musekiwa was ordered by the court to pay $120 per month for the welfare of the four children he sired with Chenai Gweshengwe.

“Musekiwa and Gweshengwe are divorced. Musekiwa defaulted to pay the arrears from November 2015 to June 2016. He is in total arrears of $980,” said Mr Karombe. Mrs Chiundura sentenced Musekiwa to a two-month prison term wholly suspended on condition that he pays $50 per month from September 2, until he clears the $980.

He also ordered him to pay the monthly $120 maintenance.

“If you default any payment from now, the remaining amount will be due at once and failure to pay will lead you to prison.

“Go back to the civil court for maintenance downward variation if you are failing to afford the $120 per month,” said Mrs Chiundura.

Musekiwa was also advised to work extra hard and know that he is a father of six children who need to be taken care of.
